Update:  On May 21, 2012, AEP-Ohio filed a memorandum contra to IEU-Ohio’s application for rehearing. In its memorandum contra, AEP-Ohio argues that: 1) the PUCO should deny IEU-Ohio’s application because it raises no new issue for review; and, 2) the result IEU-Ohio seeks is contrary to PUCO and Ohio Supreme Court precedent and would violate federal law. The PUCO must issue an entry on rehearing by June 11, 2012. However, the PUCO often issues a non-substantive entry on rehearing granting itself additional time to rule on rehearing.
