Recall that on April 2, 2013, Duke filed a joint stipulation resolving all but the issue of cost recovery associated with the environmental cleanup of two of Duke’s facilities.  A hearing on this one issue concluded on May 2, 2013.  Post hearing briefs were filed June 6, 2013, and reply briefs are due June 20, 2013.  The OMAEG has not actively participated in this case because we do not have members in Duke’s territory, but did file a letter with the PUCO reserving our right to file a reply brief.  Please see attached memorandum highlighting the history of the litigated issue of cost recovery for Duke’s environmental cleanup.
