Update:  On February 13, 2013, the attorney examiner issued an entry granting the OMAEG’s motion to intervene and scheduling a prehearing conference for March 7, 2013, at 10:00 a.m. at the PUCO.  The existing procedural schedule remains as follows: 1) deadline for Duke to file testimony is March 1, 2013; 2) deadline for intervenors and PUCO Staff to file testimony is March 19, 2013; and, 3) the hearing is scheduled to commence on April 2, 2013, at 10:00a.m. at the PUCO.  The OMAEG awaits a ruling regarding our motion for the PUCO to dismiss Duke’s request for cost-based capacity pricing.  We will continue to monitor this case and provide updates.
