Update: On April 2, 2013, Duke filed a joint stipulation with the PUCO, whereby Duke and signatory parties agreed to no annual increase, which is a decrease from Duke’s initial request of $46.6 million annually. The OMAEG has not actively participated in this case because we do not have members in Duke’s territory and the PUCO Staff report did not raise significant issues. Therefore, the OMAEG did not sign the stipulation but did not oppose it either. The PUCO will likely issue an entry soon. An outstanding issue in this case that will be litigated is the method of cost recovery associated with the cleanup of one of Duke’s facilities. We will continue to monitor this case and provide updates accordingly.
