Update: IEU-Ohio and DP&L are currently engaged in a discovery dispute about information pertaining to coal plants that are proposed for inclusion in DP&L’s Reliable Electricity Rider (RER). IEU-Ohio maintains that the information may shed light on DP&L’s need for the RER; however, DP&L states the information is not discoverable because, among other things, it is privileged and not relevant to the outcome of the case. The PUCO has yet to resolve the dispute.
