On August 31, 2015, Sierra Club filed notices of deposition of the numerous witnesses who filed testimony supporting AEP’s amended application for approval of inclusion in its PPA rider the proposed affiliate PPA with AEP Generation Resources and its OVEC entitlement. The depositions are scheduled to begin on September 15, 2015.

On September 1, 2015, the Environmental Law and Policy Center (ELPC) filed an affidavit in support of the August 21, 2015 reply to AEP’s memorandum contra several parties’ joint motion to extend the procedural schedule. The notice accompanying the affidavit specified that the affiant was physically unavailable to sign the affidavit the same week that the reply was filed because he was vacationing. Subsequently, AEP filed correspondence in the docket questioning the propriety of the affidavit filed in support of the joint motion. On September 3, 2015, ELPC filed a motion to strike the correspondence AEP filed, as the correspondence, which amounts to a request for relief, procedurally improper.
