Update: Recall that Duke filed an application to defer the difference between its costs and the market price for capacity and to establish a cost-based charge, pursuant to Ohio’s newly adopted state compensation mechanism. This week, a joint group of intervenors drafted a joint motion to dismiss for the PUCO to deny Duke’s request for cost-based capacity pricing. It is our recommendation that the OMA sign on to the motion to dismiss which will be filed late next week.
