Update: AEP filed testimony in support of a stipulation reached between itself and Staff that seeks to resolve AEP’s significantly excessive earnings test cases for 2014 and 2015. Through discovery, AEP admitted that it never contacted OMAEG prior to filing the stipulation. AEP’s exclusion of OMAEG from settlement discussions involving the stipulation contravenes Ohio Supreme Court precedent requiring that all customer classes be afforded an opportunity to participate in settlement. Opponents of the stipulation will file their testimony next week. A hearing is scheduled for October 7, 2016.
