Update:  The hearing on Duke’s electric security plan application has continued over the past week.  Presently, the hearing is scheduled to conclude on November 7, 2014, although it is anticipated that a number of additional days of hearing may be necessary thereafter.  Moreover, on October 27, 2014, OCC filed an interlocutory appeal and request for review of the attorney examiner’s decision ordering disclosure of confidential email communications among the attorneys whose clients entered into a joint defense agreement with OCC.  OMA Energy Group, Ohio Energy Group, and Industrial Energy Users-Ohio filed correspondence with the Commission supporting OCC’s interlocutory appeal.  Duke filed a memorandum contra the interlocutory appeal on October 29, 2014, and OCC filed a reply on October 30, 2014.
