Update: Previously, on July 30, 2014, IEU-Ohio, the Ohio Consumers’ Counsel (OCC), Ohio Energy Group (OEG), and Ohio Partners for Affordable Energy (OPAE) filed a motion requesting the Commission to stay the Commission’s ESP Order to prevent DP&L from collecting certain amounts from its customers through the Service Stability Rider. On October 1, 2014, the Commission denied the motion, stating that it has previously established that the Commission will not issue a stay in a proceeding once an appeal has been filed. In light of the fact that IEU-Ohio previously appealed the Commission’s decision in these cases to the Supreme Court of Ohio, the Commission did not grant the requested stay.
