Update: On October 3, 3013, the attorney examiner issued an entry scheduling a hearing for November 14, 2013.  On October 9, 2013, the Ohio Energy Group (“OEG”) filed a motion requesting the PUCO to amend the procedural schedule in order to develop a more complete record upon which the PUCO can base its decision.  More specifically, OEG requests the PUCO to:

• set a deadline for Republic to file testimony in support of its Application;
• provide an opportunity for intervenors to file testimony;
• extend the hearing date to allow the filing of testimony and to allow parties to conduct discovery; and
• rule on the unopposed motions to intervene.

In a related development, Republic recently reached out to counsel in the case asking to discuss settlement.  Counsel will seek input from the OMAEG on settlement goals and objectives in order to develop a strategy for settlement negotiations.
