Update:  On November 13, 2014, Noble Americas Energy Solutions LLC (Noble), an Ohio certified retail electric service (CRES) provider, filed correspondence in the docket indicating its concern that issues in this complaint proceeding and other similar complaint cases against FirstEnergy Solutions (FES) may be decided by the Commission in a manner that impacts Noble’s customer agreements.  Noble further indicated that it believes the RTO Expense Surcharge complaints are “inextricably linked” to the issues under consideration in the Commission’s investigation into certain marketing practices of CRES providers, and that any findings the Commission may issue in the complaint cases may impact the investigation.  Although Noble related its concerns in the correspondence, it also noted that presently, it is not seeking to intervene in the case.
