Update:  On October 18, 2013, Industrial Energy Users-Ohio (IEU-Ohio) filed a notice of additional authority in support of its argument that the Commission does not have jurisdiction to increase the amount of compensation provided to Duke Energy Ohio for the provision of wholesale generation-related capacity service.  Duke Energy Ohio filed a motion to strike IEU-Ohio’s notice on October 21, 2013.  A Commission decision on the issue is pending.
