Update: This week, several parties submitted testimony prior to the deadline, including: 1) Constellation NewEnergy, Inc; 2) Direct Energy Services, LLC; 3) Direct Energy Business, LLC; 4) Exelon Generation Company, LLC; 5) IGS; Northeast Ohio Public Energy Council; 6) Northwest Ohio Aggregation Coalition; 7) OCC; 8) Retail Energy Supply Association; and, 9) The Sierra Club. Most of the testimony addresses the uncertainty of the market, particularly for FirstEnergy right now and whether it is a good idea to lock into rates at present for future periods. Intervenors also raised concerns about the impact of FirstEnergy’s announced transmission upgrades to reduce transmission constraints. Several conclude that FirstEnergy’s proposed ESP is not more favorable in the aggregate than an MRO and most conclude that given the moving parts, an expedited process is not in the best interest of customers. The evidentiary hearing is set to commence on June 4, 2012, at 10:00 a.m. at the PUCO.
