Update: This week, the attorney examiner granted motions to intervene for the following parties: 1) AEP Retail Energy Partners, LLC; 2) Constellation NewEnergy, Inc; 3) DP&L; 4) Direct Energy Services, LLC; 5) Direct Energy Business, LLC; 6) Duke Energy Commercial Asset Management, Inc; 7) Duke Energy Retail Sales, LLC; 8) Exelon Generation Company, LLC; 9) IGS; 10) Natural Resources Defense Council; 11) Northeast Ohio Public Energy Council; 12) Northwest Ohio Aggregation Coalition; 13) OCC; 14) Ohio 15) Ohio Environmental Council; 16) Ohio Partners for Affordable Energy; 17) Ohio Power Company; 18) OMA Energy Group; 19) Retail Energy Supply Association; and, 20) the Sierra Club.Additionally, the attorney examiner granted in part, and denied in part, Direct Energy Services, LLC and Direct Energy Business, LLC’s motion to compel discovery from FirstEnergy. Specifically, in two document requests, Direct requested that FirstEnergy produce copies of a FirstEnergy customer’s bills, with personal information redacted, if necessary, to help support Direct’s argument that the stipulation should be modified to include a receivables purchase program. The PUCO granted, in part, Direct’s request.
