Update:  On May 14, 2014, the City of Miamisburg filed a motion for leave to intervene in the case.  Additionally, on May 14, OCC filed a motion to compel DP&L to provide responses to certain of its discovery requests, arguing that DP&L’s primary objection to OCC’s requests, that there is no need for discovery unless a hearing is ordered, conflicts with a Commission rule which permits discovery to begin once a proceeding is commenced.
