Update: Kroger moved to intervene in a case filed by Duke that seeks a waiver of a PUCO rule requiring electric distribution utilities to file their EE/PDR program portfolio plans by April 15. Duke seeks to delay the filing of its plan until October 15. According to Duke, it should be given more time to file its plan so that it can align the features of its plan with the outcomes of energy-efficiency-related matters pending before the PUCO and the General Assembly.  Kroger argues that Duke should follow the law as it currently exists.  The procedural schedule envisioned by Duke’s waiver filing is a sharp departure from the procedural schedule that applied to the proceeding on Duke’s last plan.  OMA Energy Group will be intervening in the case.
