Update: OMA Energy Group and other opponents to the PPA settlement filed responses to counter FirstEnergy’s arguments that certain passages in the opponents’ briefs included references to inadmissible evidence. This dispute continues the ongoing strategy undertaken by FirstEnergy to limit the scope of evidence available for the PUCO to review. OMA Energy Group maintains, among other things, that the PUCO should take notice that one of the signatories to the settlement, the Consumer Protection Association (CPA), is no longer in existence. FirstEnergy has claimed that its proposal is supported by a diverse class of customers, but the cloud of uncertainty hanging over CPA casts doubt on the validity of the stipulations.
