Update:  OMA and OCC filed a joint notice of second appeal with the Supreme Court of Ohio appealing the Commission’s decisions in its Opinion and Order and Entry on Rehearing in this proceeding.  The Kroger Company filed its third notice of appeal with the Supreme Court of Ohio.

OMA, Kroger, and Ohio Partners for Affordable Energy filed letters of notification informing the Commission of its intent to request a stay of the Commission’s Opinion and Order, Entry on Rehearing, and Entry authorizing Duke to collect $55 million from customers for the investigation and remediation of MGP sites.
