Update: The Commission granted in part and denied in part the applications for rehearing filed by Duke, FirstEnergy, and the Ohio Consumers’ Counsel. The Commission added language back into the proposed rules that allows a two day time frame in which a party may correct a paper filing. If the filing is not corrected within that two day time period, the filing will be rejected. The Commission also clarified that the opinions of non-party members of the public, whether written or oral, do not serve as an evidentiary basis on which the Commission renders its decision.
