Update: Regarding issues that were remanded from the Ohio Supreme Court, the Office of the Ohio Consumers’ Counsel moved to strike the testimony of AEP’s witness who claims that AEP should be entitled to retroactively increase customer rates by $470 million for capacity-related charges. As OMA Energy Group has previously argued, accepting the claims supported by AEP’s witness would violate the prohibition against retroactive ratemaking. AEP claims the rate increase is necessary to make up for costs it incurred to provide capacity to load served by CRES providers. Parties are awaiting next steps from the PUCO.
