Update: On June 29, 2015, OMA filed a memorandum contra the applications for rehearing filed by Duke and the Environmental Advocates. Specifically, OMA argued that the Commission’s determination that Duke may not use banked savings to earn a shared savings incentive in a year (such as 2013) in which it has not met its benchmarks by means of the savings achieved by its approved programs is reasonable and supported by the record.
