Update: DP&L advised the PUCO that it was waiving its right to put its requested rate increase into effect subject to refund. By law, a utility is permitted to implement a request for a rate increase, subject to refund, if the PUCO does not issue an order on the case within 275 days from the date of the filing of the application. DP&L explained that it understands that the PUCO will not be able to issue an order within the 275-day window due to the complexity of the case and the volume of information that parties have requested through the discovery process.
