Update: Recall that on July 15, 2013, Ormet filed an interlocutory appeal of the July 11, 2013 attorney examiner entry requesting the PUCO to reverse the entry with respect to the procedural schedule, and schedule an oral argument for the week of July 22, 2013 to allow the PUCO to fully consider and resolve whether an emergency exists, and whether Ormet’s request for emergency relief should be granted.
On July 25, 2013, the attorney examiner denied Ormet’s request for an oral argument, but granted Ormet’s interlocutory appeal so that the PUCO can reevaluate its initial entry, which denied Ormet emergency relief. It is possible that the PUCO could grant Ormet emergency relief before July 31, 2013 as Ormet requests, but this is unlikely given opposition by AEP-Ohio, as well as several intervening parties.
