Update: The University of Cincinnati, Miami University, and Retail Energy Supply Association all filed motions for leave to intervene. The Environmental Law and Policy Center, Natural Resources Defense Council, City of Cincinnati, Wal-Mart Stores East, LP, and Sam’s East, Inc., and EnorNOC, Inc. each filed motions to intervene on July 8, 2014.
On July 9, 2014, Duke filed a motion for protective order related to its dispute with OCC regarding a confidentiality/protective agreement. The motion does not mention Duke’s dispute with other intervening parties relating to confidentiality/protective agreements.
OMA, Kroger, OCC, and Ohio Partners for Affordable Energy filed a joint motion to reject Duke’s May 29, 2014 application arguing that Duke did not meet the statutorily mandated filing requirements. The motion requests that Duke’s application is rejected and that it is ordered to file another application that is in compliance with Ohio statutes. If the motion is granted, the parties requested that a new procedural schedule be set.
