Update: The Environmental Law and Policy Center (ELPC) and OCC filed notices of appeal to the Supreme Court of Ohio. ELPC contends in its notice of appeal that the Commission unreasonably held that certain information was confidential, including renewable energy credit (REC) prices, seller identities, and recommended penalty amounts. OCC argues in its notice of appeal that the Commission failed to disallow costs for imprudently incurred RECs.
