Update: The Ohio Supreme Court has scheduled an oral argument for January 6, 2016 to address the appeal of the Commission’s decision on FirstEnergy’s application for a third electric security plan. The Northeast Ohio Public Energy Council (NOPEC) argued that FirstEnergy’s plan fails the statutory test which requires that the plan be more favorable in the aggregate than a market rate offer. NOPEC raises several other arguments, including that the Commission’s approval of the stipulation should be reversed for lack of serious bargaining among the parties. The Environmental Law and Policy Center has also challenged the Commission’s decision on the theory that FirstEnergy’s application did not meet the Commission’s administrative requirements.
