Update: Over the last week, various motions pertaining to disputes over discovery-related issues have continued being filed. On December 18, 2014, a prehearing conference was held in order to resolve certain motions and other procedural matters, namely the outstanding discovery disputes that are currently pending in the case. Among other issues addressed at the conference, the attorney examiner took arguments on whether FirstEnergy has to produce governmental aggregation data to IGS Energy. A decision on this matter will be issued by entry.  Privilege logs were also ordered to be produced for joint defense agreement claims. Privilege logs will be examined and arguments regarding the same will be heard on December 30, 2014 at a subsequent prehearing conference. Additionally, Duke Energy Ohio indicated at the prehearing conference and by subsequent filing that it would no longer be participating in the case.
