Update: On August 4, 2014 the OCC filed a motion for subpoena decus tecum requesting that the Commission subpoena the Ohio Valley Electric Corporation to produce a person to attend and give deposition testimony on August 12, 2014 at the office of the OCC. Also on August 4, Duke filed a number of deposition notices for the individuals that will testify on behalf of the intervening parties. Duke noticed a deposition for any individual that testifies on behalf of OMA for September 2, 2014 at 12:30 p.m.
The Attorney Examiner granted OMA’s motion to intervene in this proceeding and extended the procedural schedule. The new procedural schedule is as follows:
- Discovery cut-off: September 22, 2014
- Intervenor Testimony Due: September 26, 2014
- Staff Testimony Due: October 2, 2014
- Evidentiary Hearing: October 7, 2014
The Attorney Examiner denied the joint motion of OMA, Kroger, Ohio Partners for Affordable Energy, and the OCC to reject Duke’s Application. The Attorney Examiner scheduled a prehearing conference for August 12, 2014 at 1:30 p.m. at the Commission in hearing room 11A to address the motions that remain pending.
