Update: The PUCO invited parties to file comments on DP&L’s proposal to withdraw the rates from its second electric security plan (ESP 2) and replace them with rates that it claims are consistent with the PUCO’s decision on its first electric security plan (ESP 1). DP&L’s proposal was prompted by the Ohio Supreme Court’s decision which reversed the PUCO’s authorization of DP&L’s Service Stability Rider which arose out of the ESP 2 proceedings. DP&L is mischaracterizing this decision to support its misguided argument that the Court reversed the entirety of the PUCO’s decision on DP&L’s ESP 2.
