Update:  On August 1, 2012, the PUCO issued an Entry directing ASHTA to file, within twenty (20) days of the issuance of the Entry, additional information regarding ASHTA’s request for a reasonable arrangement between itself and FirstEnergy so that the PUCO can accurately evaluate ASHTA’s application. Accordingly, the PUCO indicated that should ASHTA move forward with its application prior to submitting a recommended price per kWh, a recommended discount per kWh, and an estimated delta revenue, then the PUCO will dismiss the application without prejudice.
