Update: This week, OMAEG counsel actively participated in the evidentiary hearing which concluded on August 28, 2013. The evidentiary hearing was a very transparent process that allowed parties to evaluate the details of Ormet’s request to amend its unique arrangement. It is clearly apparent that aluminum prices continue to greatly impact the health of Ormet’s business. However, as in the past, other ratepayers remain at risk in the event that Ormet does not return to profitability in the near future.
Unlike in most PUCO proceedings, the attorney examiner will only allow parties to submit a post hearing brief; parties will not have the opportunity to submit reply briefs. Accordingly, post hearing briefs are due by Monday, September 9, 2013. Because of the transparency of the evidentiary hearing, OMAEG counsel recommends filing a letter which encourages the PUCO to critically and fairly review everything in the case docket in making its final decision.
