Update: After working through the reactions of other parties, DP&L and the OMAEG have come to an agreement. The agreement provides that DP&L will provide the OMA, from shareholder funds, with an annual $30,000 payment and an additional one-time payment of $30,000 to be used toward research. The majority of intervening parties have indicated that they are in agreement with DP&L and support the larger stipulation.
Counsel participated in a conference call on August 19, 2013 with DP&L and numerous intervening parties about the settlement status. Based upon the conference call, DP&L is optimistic that it will resolve many, if not all, issues in this case. Accordingly, DP&L filed a motion to extend the deadline for intervening parties to file comments and objections. On August 22, 2013, the attorney examiner granted DP&L’s request; thus, comments and objections are now due on August 29, 2013. We will continue to participate in settlement discussions and will provide updates accordingly.
