Update:  On August 18, 2014, Duke filed an interlocutory appeal challenging the Commission’s August 12, 2014 oral ruling granting in part and denying in part Duke’s July 8, 2014 motion for protective order.  Specifically, Duke is challenging the Commission’s ruling which allows parties to retain confidential information and use it for future proceedings.  In addition to this interlocutory appeal, there remains a dispute about the confidentiality agreement at the Commission level.  On August 21, 2014, OMA, OCC, IGS Energy, and Ohio Partners for Affordable Energy filed a letter with the Commission requesting a telephonic conference to address the remaining issues.
