Update:  On August 11, 2014, OMA filed a reply in support of its motion to intervene.  OMA argues that its members have a real and substantial interest in the outcome of this proceeding and that such interest is not “speculative” as claimed by Power4Schools (P4S).  OMA states a number of its members purchase electric generation services from FES and have been improperly assessed (or noticed that they will be assessed for) charges for ancillary services based upon their usage during the month of January 2014.  OMA also argues that it is not necessary for it to initiate its own complaint proceeding and that OMA was not required to allege that it has a contract with FES as it is filing the motion to intervene on behalf of its affected members.

On August 11, 2014, the Timken Company, Marathon Petroleum Company, Wausau Paper Towel and Tissue LLC, ASHTA Chemicals Inc., Columbus Castings, the Lincoln Electric Company, Delphi Corporation, and Landmark Plastic Corporation (collectively, Industrial Customers) filed a joint reply in support of their motions to intervene and for interim and preliminary orders.

On August 13, 2014, FirstEnergy also filed a memo contra to OMA’s motion to intervene.  OMA plans to file a reply in support of its motion next week.
