Update: Based on discussions at the OMAEG board meeting on April 3, 2013, the OMA will not be filing any written testimony in this case and will not be putting on any witnesses. Similar to the DP&L ESP case, the OMA will advocate its opposition to Duke’s request for a cost-based capacity charge in its post-hearing brief. OMA will also continue to present arguments at the hearing and in its post-hearing brief that Duke’s capacity case should be dismissed because of Duke’s previous agreement and stipulation in its ESP case. The evidentiary hearing is scheduled to commence on April 15, 2013, at 10:00 a.m. at the PUCO.
