Update: On April 2, 2015, the Commission issued a finding and order granting AEP Ohio’s application requesting approval to continue its implementation of the retail stability rider (RSR), and denying the pending motion to dismiss the case for lack of Commission jurisdiction under state law and is preempted under federal law from approving AEP Ohio’s application. The finding and order authorizes AEP Ohio to utilize its final implementation plan to continue the current $4.00 per MWh RSR charge, beginning on June 1, 2015, and continuing over a collection period of 32 months, until the remaining capacity deferral and carrying charge balance is fully recovered.

Applications for rehearing of the Commission’s finding and order are due on May 4, 2015. Counsel is evaluating the possibility of filing an application for rehearing on grounds explored previously in comments filed on AEP Ohio’s application.
