Update: OMA Energy Group filed a memorandum opposing FirstEnergy’s request to keep confidential certain cost projections associated with the Affiliate PPA. The cost projections relate to aggregate data, not competitively sensitive information. Given that the data was merely cast in the aggregate, OMA Energy Group argued that disclosing the data would not place FirstEnergy or its affiliate at a competitive disadvantage. OMA Energy Group further argued that disclosure of the data was consistent with the PUCO’s general rule which treats as public all facts and information in the PUCO’s possession.
