Update:  On April 10, 2015, Central Ohio Technical College, Cleveland State University, Kent State University, Northwest State Community College, Ohio University, the University of Akron, and the University of Toledo (collectively, Complainants) filed a memorandum contra FirstEnergy Solutions’ (FES) motion to dismiss the case.  In their memorandum contra, Complainants argue that the Commission has jurisdiction to hear the case, that the complaint properly sets forth claims that FES violated a number of statutes and Commission rules, and that the complaint seeks a finding from the Commission that FES engaged in unfair, misleading, deceptive, and unconscionable conduct, rather than a Commission finding that FES has breached the contracts it has with each of the Complainants.
