Update:  On April 4, 2014, the Commission transmitted the docket in the MGP matter to the Supreme Court of Ohio for use in the appeals of the Commission’s Opinion and Order.  Further, on April 9, 2014, OMA, OCC, Kroger, and Ohio Partners for Affordable Energy (OPAE) filed a joint motion to strike Duke’s memorandum contra the second joint application for rehearing, as well as a motion to strike Duke’s motion for leave to file its “Memorandum Contra Motion to Consolidate of Ohio Power Company, Instanter,” which Duke improperly captioned as an Ohio Power Company motion or proceeding.
