Update: In July, the Office of the Ohio Consumers’ Counsel (OCC) filed a motion with the Supreme Court of Ohio, requesting that the Court stay the collection of the Rate Stability Charge (RSC) during the pendency of the appeal. OCC argued that the stay was warranted because the RSC is unlawful and customers will not be able to recover charges that have already been collected if the Court ultimately determines that the RSC is unlawful. This week, the Court denied OCC’s motion with Justice O’Neill dissenting. The parties are awaiting an oral argument schedule.
