Update: After several attempts to settle the case, FirstEnergy and the intervening parties were unable to come to an agreement. Accordingly, the hearing ended on October 30, 2012 with the completion of FirstEnergy’s rebuttal testimony. The attorney examiner set November 20 as the deadline for initial briefs and November 30 as the deadline for reply briefs. The OMAEG will participate in the brief process by emphasizing to the PUCO that FirstEnergy’s energy efficiency programs are insufficient and cumbersome for manufacturers to adopt and that properly managed energy efficiency programs are more efficient than the alternative. After the submission of initial briefs and reply briefs, the PUCO will evaluate the case record and issue a determination. We will continue to provide updates accordingly.
