Update: FirstEnergy asked the PUCO once again to strike selected passages mentioned in the briefs filed by OMA Energy Group, Ohio Consumers Counsel (OCC), and other opponents to the PPA request and settlement. As before, FirstEnergy seeks to improperly exclude evidence sponsored by OMA Energy Group witness Dr. Ned Hill about the status of a signatory party known as the Consumer Protection Association (CPA). Dr. Hill’s devastating testimony showed that it is doubtful whether CPA is in existence, given that CPA filed a dissolution request and is under investigation for fraud. OMA Energy Group has argued that it would be highly inappropriate for the PUCO to grant CPA hundreds of thousands of dollars per year for each year of the settlement’s eight-year term given the cloud of uncertainty hanging over CPA’s status.
