Update: The Ohio Supreme Court issued a mandate to finalize its decision on DP&L’s Service Stability Rider (SSR). In its decision, the Court reversed the PUCO’s authorization of the SSR because it enabled DP&L to collect the equivalent of transition revenue in contravention of Ohio law. Parties have been relying on this decision to support a request that urges the PUCO to vacate its authorization of the SSR. In response, DP&L countered that the PUCO cannot take action on the parties’ request until the Court issues its mandate on the decision. With the mandate now issued, DP&L’s opposition to vacating the SSR is now without merit. It is estimated that DP&L has so far collected about $250 million through the SSR and that another $80 million remains to be collected.
