Update: The PUCO has reversed one of its earlier rulings and held that the Office of the Ohio Consumers’ Counsel (OCC) is entitled to receive records related to AEP’s alleged double recovery of certain capacity-related costs. A final audit report found that AEP may have over-recovered these costs by as much as $120 million. To investigate the issue further, OCC filed a public records request with the PUCO seeking a draft of that report. The draft report was provided to AEP for review prior to the issuance of the final audit report, but the draft was not made available to other parties. AEP opposed OCC’s public records request, arguing that the information in the draft report was confidential and therefore protected from disclosure. In an earlier ruling, the PUCO agreed with AEP and held that the draft audit report could not be disclosed. Pursuant to the new ruling, however, OCC and others are now entitled to receive the draft.
