Update: The U.S. Supreme Court heard oral arguments on the legality of a Maryland Public Service Commission plan to boost in-state generating capacity. Lower courts struck the plan down as unlawfully intruding on FERC’s exclusive jurisdiction to oversee the wholesale power markets.
