Update: On August 7, 2015, the attorney examiner issued an entry setting a procedural schedule for the PPA Expansion proceeding. Pursuant to the schedule, the following dates of interest/deadlines were established:
- Intervenor testimony must be filed by September 11, 2015
- Staff testimony must be filed by September 18, 2015.
- A prehearing conference is scheduled for September 22, 2015
- The evidentiary hearing is scheduled to commence on September 28, 2015
On August 11, 2015, numerous parties, including OMA Energy Group, filed a motion to extend the procedural schedule established in the August 7 Entry. In the motion to extend, the Joint Movants argued that sufficient time must be afforded to the intervening parties to conduct pre-hearing discovery, formulate recommendations for the Commission to consider, and prepare for and participate in an evidentiary hearing. The Joint Movants further contended that due to the expected length of the evidentiary hearing in the FirstEnergy ESP IV proceeding, the procedural schedule established in the August 7 Entry did not provide the parties sufficient time for case preparation, did not provide sufficient time in which to hold the necessary local public hearings in this proceeding, and will not provide the parties adequate time to address the results of the upcoming PJM Interconnection L.L.C. (“PJM”) capacity auctions, which will have a significant impact on the price of power secured under the purchase power agreement.
