Update: AEP, FirstEnergy, and their unregulated generating affiliates (Respondents) filed notices at FERC of the PUCO’s recent decisions on AEP’s and FirstEnergy’s PPA settlement requests. The Respondents assert that the PUCO’s decisions show that customers are not captive to the costs of the abusive affiliate contracts. In response, RESA, Dynegy, and others argue that the PUCO’s decisions are irrelevant because customers cannot avoid the costs of the abusive affiliate contracts by shopping with a competitive supplier. The PUCO announced that it will be filing comments on Monday in the two cases.
