Ohio Supreme Court Upholds Financial Institutions Tax

The Ohio Supreme Court has upheld the state’s financial institutions tax, rejecting a challenge from Pittsburgh-based Dollar Bank that argued Ohio’s tax structure discriminates against interstate commerce.

The unanimous decision found Ohio’s tax is fairly apportioned because it applies only to the share of a financial institution’s equity capital tied to business conducted in the state. The ruling offers another indication of how Ohio courts are approaching tax apportionment and interstate commerce issues that can affect the broader business community.

“While this case involves financial institutions, the court’s analysis is worth watching across Ohio’s business community,” said Jacob Sargent, director of public policy services for the Ohio Manufacturers’ Association. “A predictable and constitutionally sound tax system is an important part of maintaining a competitive business climate.” 8/18/2026
